Return rights and warranties for U.S. commercial sellers

If you're a commercial seller based in the U.S., different rules apply compared to the EU. There’s no automatic right of return and no legally mandated warranty—these terms need to be clearly agreed upon between you and the buyer.

No automatic return policy

Unlike in the EU, buyers in the U.S. don’t have a guaranteed right to return a bike within a specific period unless you, the seller, offer one. If you'd like to offer a return window (e.g. 7 or 14 days), make sure it’s clearly stated in your ad description.

A return policy is optional, but setting one can help build trust with buyers.

No statutory warranty

There’s no federal law requiring you to offer a warranty on used bikes. However, if you do offer any kind of warranty—even informally—it becomes legally binding, so be clear about what’s covered and for how long.

Common practices include:

  • Limited warranty for specific components (like a drivetrain or frame)

  • Exclusions for wear parts (tires, chains, brake pads, etc.)

Warranty issues must be resolved directly between you and the buyer.
